In Texas, Burglary is a felony offense. An individual unlawfully entering or remaining in a building or dwelling with the intention of committing a felony offense, theft, or assault performs burglary. Penalties for the Criminal Offense of Burglary

  • Burglary of a building constitutes a state jail felony punishable by up to 2 years in prison and a fine of $10,000.
  • Burglary of a habitation (home) constitutes a 2nd degree felony punishable by up to 20 years in prison and a fine of $10,000.
  • Burglary may become a 1st degree felony punishable by up to life in prison and a $10,000 fine if an individual entered a habitation and the person entered with the intent to commit a crime other than theft (i.e. rape or assault).
